Inclusive App Craft
Terms of Service
Last updated 4 September 2026
These Terms of Service ("Terms") are a legal agreement between you and Inclusive App Craft ("Inclusive App Craft", "we", "us", or "our") governing your access to and use of Webscan, our accessibility auditing and compliance platform, and this website (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who may use the Service
You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of an organisation, you represent that you are authorised to accept these Terms for that organisation, and "you" includes that organisation.
2. Accounts
You must provide accurate registration information and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorised use. Access to organisation content is governed by the roles assigned to members; you agree to configure and manage those roles responsibly.
3. The Service
Webscan renders and inspects websites, runs automated accessibility checks, supports manual audits and behavioural review, helps you manage remediation, and produces reports. Automated results are evidence, not a determination of legal or standards conformance. Accessibility conformance requires qualified human judgment. You are responsible for how you interpret and act on the output of the Service.
4. Authorisation to scan websites
This is a condition of using the Service. You may use the Service only to scan or test websites and systems that you own or for which you have obtained clear, documented authorisation from the owner. You must not use the Service to access, test, probe, or place load on any website or system without permission, to circumvent security or access controls, or in any way that violates the rights of others or applicable law. You are solely responsible for verifying that you have the necessary authorisation before initiating any scan, audit, journey, or remediation action.
Verifying your authorisation
Before you can use features that sign in to a target website or otherwise interact with it on your behalf — authenticated scanning, agentic exploration, and user journeys — you must prove that you control the target domain by placing a verification token we provide (in the domain's DNS records, in a file at the site's web root, or on the site's home page). Holding a user login on a website is not, by itself, authorisation; control of the domain is. If you are conducting an audit for a third party, the site owner's placement of the verification token constitutes that owner's authorisation for you to test the domain.
Usage limits
We may apply reasonable limits to the volume and rate of scans and other activity for each organisation, to protect the Service and the websites it tests. We may adjust these limits, and may decline or delay requests that exceed them.
Monitoring, records, and enforcement
We keep a tamper-evident record of security-relevant activity — including scans, authenticated sign-ins, and domain-verification outcomes — to operate the Service securely and to establish accountability. We may review activity that appears to indicate unauthorised or abusive use. If we determine that the Service is being used against a website without authorisation, or otherwise in breach of these Terms, we may suspend or terminate the responsible account, with or without notice. If you believe your website is being scanned through the Service without your authorisation, you may report it to us at [email protected] or via our Report abuse page.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful, deceptive, or abusive purpose.
- Attempt to breach, disable, or interfere with the security or integrity of the Service or the systems of other users.
- Access data or accounts that do not belong to your organisation, or attempt to defeat the Service's tenant boundaries.
- Reverse engineer, resell, or create derivative services from the Service except to the extent permitted by law.
- Upload malicious code, or use the Service to distribute or facilitate malware.
- Use the Service to target internal, private, or restricted network resources you are not authorised to test.
6. Credentials and connected services
If you supply authentication state for a target website or an access token for a code repository, you confirm you are entitled to provide and use those credentials for scanning or remediation. You are responsible for the scope and permissions of any token you provide and for revoking it when it is no longer needed. Connected third-party services (such as an external AI provider or a code-hosting provider) are governed by their own terms; we are not responsible for those services.
7. AI-assisted features
The Service can generate advisory drafts to help you understand and remediate issues. These drafts are suggestions only. They are recorded with their provenance, always require human review and approval, and never automatically modify your data, change issue states, write to your code, or assert conformance. You are responsible for reviewing, testing, and deciding whether to act on any generated content.
8. Your content
You retain all rights to the content and data you submit to or generate within the Service ("Your Content"). You grant us a limited licence to host, process, and display Your Content solely to provide and support the Service. You are responsible for Your Content and for ensuring you have the rights necessary to submit it, including any personal data contained in scanned pages.
9. Our intellectual property
The Service, including its software, design, and branding, is owned by Inclusive App Craft and protected by intellectual-property laws. Except for the rights expressly granted to you in these Terms, we reserve all rights in and to the Service. "Inclusive App Craft" and "Webscan" are our marks and may not be used without our prior written permission.
10. Fees
Some features of the Service may be offered free of charge and others may require a paid plan. Where fees apply, they will be described to you before you incur them, and the applicable pricing and payment terms will form part of these Terms.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that its automated findings are complete or that acting on them will achieve or maintain any particular standard of accessibility or legal compliance.
12. Limitation of liability
To the maximum extent permitted by law, Inclusive App Craft will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or the equivalent of one hundred United States dollars.
13. Indemnification
You agree to indemnify and hold harmless Inclusive App Craft and its personnel from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your scanning or testing of any website or system without proper authorisation.
14. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service, its users, or the public. Provisions that by their nature should survive termination will survive, including intellectual-property, disclaimer, liability, and indemnification provisions.
15. Governing law
These Terms are governed by the laws of the Republic of Ghana, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the competent courts of Ghana for any dispute arising out of or relating to these Terms or the Service, subject to any mandatory rights you may have under applicable law.
16. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date shown at the top of this page, and material changes may also be communicated through the Service. Your continued use of the Service after an update takes effect constitutes acceptance of the revised Terms.
